These Terms of Service govern your access to and use of the Fidelity Arms website, online courses, digital materials, memberships, community features, in person training, and related products and services.
In these Terms, “Fidelity Arms,” “we,” “us,” and “our” refer to Fidelity Arms, doing business as Fidelity Arms. “You” and “your” refer to the person accessing the website or purchasing or using our services.
By accessing the website, creating an account, making a purchase, registering for training, or selecting a button indicating your acceptance, you agree to these Terms of Service and our Privacy Policy.
Do not use the website or purchase our services unless you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, purchase a membership, or buy our services.
Certain in person training programs may have additional eligibility requirements. These requirements may include minimum age, lawful eligibility to possess or handle firearms, prior training, required equipment, or completion of a separate liability waiver.
A parent or legal guardian may be required to register for and consent to a minor’s participation in any program that permits minors.
You represent that all information you provide to Fidelity Arms is accurate, complete, and current.
2. Nature of Our Services
Fidelity Arms may provide:
- Online firearms education and shooting related courses
- Downloadable materials, videos, workbooks, guides, and other digital content
- Paid memberships and community access
- In person firearms instruction, competition shooting instruction, seminars, clinics, and private coaching
- Free educational articles, videos, podcasts, and other informational content
Specific services, features, instructors, schedules, pricing, and availability may change.
3. Educational Purposes and No Guarantee of Results
Fidelity Arms provides education, instruction, and training resources. Individual results vary according to experience, physical ability, equipment, practice, judgment, and other factors.
We do not guarantee:
- Improvement within a particular period
- Achievement of any competitive classification or performance level
- Successful completion of a course or qualification
- Employment, certification, licensing, or legal eligibility
- That techniques presented will be suitable for every individual or situation
Testimonials, student results, and examples describe individual experiences and do not guarantee that you will obtain the same results.
4. Firearms Safety and Legal Compliance
Firearms and shooting activities involve inherent risks, including serious injury, death, and property damage.
You are solely responsible for:
- Following all firearm safety rules
- Handling, storing, transporting, and using firearms and ammunition safely
- Following instructor commands and range rules
- Using equipment that is safe, functional, and appropriate for the activity
- Determining whether you are legally permitted to possess, transport, or use a firearm, ammunition, or related equipment
- Complying with all applicable federal, state, and local laws
Fidelity Arms content is not legal advice. Firearms laws vary by jurisdiction and can change. You should consult a qualified attorney or appropriate government authority regarding legal questions.
Online instruction is not a substitute for supervised, in person instruction when such instruction is reasonably necessary for safe participation.
5. Accounts
Some services require an account.
You agree to:
- Provide accurate account information
- Maintain the confidentiality of your password
- Restrict access to your account and devices
- Notify us promptly of unauthorized access or suspected security problems
- Accept responsibility for activity conducted through your account
Accounts are licensed to one individual and may not be shared, transferred, sold, or made available to another person.
We may suspend or terminate accounts that are shared, misused, compromised, or used in violation of these Terms.
6. Prices and Payment
Prices are displayed at the time of purchase and may change at any time. A price change will not affect a completed one time purchase, but it may apply to a future membership renewal after any notice required by law.
You authorize Fidelity Arms and its payment processor to charge the payment method you provide for:
- The stated purchase price
- Applicable taxes
- Recurring membership charges you expressly authorize
- Other charges clearly disclosed and accepted before purchase
You represent that you are authorized to use the selected payment method.
Payments may be processed by third party payment providers. We do not control their systems and are not responsible for outages, errors, or security incidents caused solely by those providers.
7. Online Courses and Digital Products
When you purchase an online course or digital product, Fidelity Arms grants you a limited, personal, revocable, nonexclusive, nontransferable license to access and use the purchased material for your own lawful, noncommercial education.
A purchase does not transfer ownership of the content or any intellectual property rights.
Unless the product description expressly states otherwise, you may not:
- Share your account or login credentials
- Copy, reproduce, republish, or redistribute course materials
- Record, download, or capture content that is not expressly made available for download
- Upload materials to another website, platform, file sharing service, or artificial intelligence system
- Sell, sublicense, rent, or commercially exploit the materials
- Use the materials to create a competing course, instructional product, or service
- Remove copyright, trademark, or ownership notices
Access periods may vary by product. “Lifetime access,” when offered, means access for the commercial life of the applicable product or platform, not the lifetime of the purchaser or an unconditional promise that the product will remain available forever.
We may update, replace, reorganize, or discontinue digital content. When reasonably practical, we will provide advance notice before permanently discontinuing paid content.
8. Digital Product Refund Policy
Unless a different refund policy is clearly displayed at checkout, the following policy applies to online courses and digital products.
8.1 Refund Period
You may request a refund within 14 calendar days after the original purchase date.
8.2 Eligibility
To qualify for a refund:
- You must submit the request within the refund period
- You must provide the email address and purchase information associated with the order
- You must not have completed more than 25 percent of the course
- You must not have downloaded a substantial portion of the included materials
- You must not have violated these Terms or misused the content
These usage limitations are intended to prevent a customer from consuming or copying most of a product and then requesting a refund.
8.3 Nonrefundable Items
The following are nonrefundable unless required by law:
- Products purchased after the stated refund period
- Fully completed courses
- Substantially downloaded digital products
- Gift cards
- Promotional or specially discounted items identified as final sale
- Purchases associated with account sharing, copying, fraud, or other misuse
8.4 Technical Problems
You must give us a reasonable opportunity to correct a technical problem before requesting a refund solely because of that problem.
If we cannot provide access to a purchased product within a reasonable period, we may provide replacement access, account credit, or a refund.
8.5 Refund Processing
Approved refunds will generally be returned to the original payment method. Processing time is controlled in part by the payment provider and financial institution.
9. Memberships and Recurring Payments
Fidelity Arms may offer monthly or annual memberships.
Before you subscribe, the checkout page will identify:
- The amount charged
- The billing frequency
- Whether the membership automatically renews
- Any introductory or trial period
- Material restrictions or conditions
By purchasing a recurring membership, you authorize us to charge the applicable membership fee and taxes to your payment method at each renewal until you cancel.
9.1 Automatic Renewal
Your membership will automatically renew at the end of each billing period unless you cancel before the renewal charge is processed.
9.2 Cancellation
You may cancel through your online account.
Cancellation stops future renewals. Unless required by law or otherwise stated, cancellation does not retroactively refund charges already processed.
You will ordinarily retain membership access through the end of the paid billing period.
9.3 Membership Refunds
Unless otherwise stated at checkout:
- Monthly membership payments are nonrefundable once processed
- Annual membership payments may be refunded within 14 days after the initial purchase
- Renewal payments may be refunded only when required by law or when a request is submitted within 3 days after an annual renewal and the membership has not been materially used following renewal
- Partial months and unused portions of a billing period are not prorated
We may approve exceptions in our discretion, but doing so in one instance does not require us to approve future requests.
9.4 Failed Payments
If a payment fails, we may:
- Retry the payment
- Ask you to update your payment information
- Suspend membership access
- Cancel the membership
You remain responsible for valid charges incurred before cancellation.
9.5 Membership Changes
We may change membership pricing or material terms. Any change affecting future renewals will be communicated in advance as required by applicable law.
Continuing the membership after the effective date of a properly disclosed change constitutes acceptance of the change.
10. Community Standards
Membership or course access may include forums, comments, group discussions, live sessions, or other community features.
You agree not to:
- Threaten, harass, intimidate, or abuse another person
- Post unlawful, defamatory, obscene, or discriminatory content
- Encourage unsafe or unlawful firearm use
- Post instructions intended to facilitate criminal conduct
- Impersonate another person or misrepresent your identity
- Publish another person’s private information without permission
- Upload malware, spam, or unauthorized advertising
- Infringe copyrights, trademarks, privacy rights, or other legal rights
- Record or distribute private community discussions without authorization
- Disrupt the operation of the website or community
We may moderate, remove, or restrict content and may suspend or terminate access for violations.
We are not responsible for opinions, advice, conduct, or content posted by users.
11. User Submitted Content
You retain ownership of original content you submit.
By posting content through Fidelity Arms, you grant us a nonexclusive, worldwide, royalty free license to host, store, reproduce, display, and distribute that content as reasonably necessary to operate and promote the applicable service.
This license does not authorize us to use your name, image, testimonial, shooting footage, or personal results in paid advertising without any additional permission required by law.
You represent that:
- You own the submitted content or have permission to use it
- The content does not violate another person’s rights
- The content is accurate to the best of your knowledge
- Posting the content does not violate any law or agreement
You may provide honest reviews and opinions about Fidelity Arms. Nothing in these Terms prohibits legally protected consumer reviews.
12. In Person Training Registration
Registration is not complete until payment has been received and Fidelity Arms has confirmed your place in the course.
You are responsible for reviewing and satisfying all prerequisites, equipment requirements, ammunition requirements, safety requirements, and range rules.
We may deny or discontinue participation when we reasonably believe that a participant:
- Presents a safety risk
- Fails to follow instructor commands
- Appears impaired by alcohol, drugs, medication, illness, or fatigue
- Uses unsafe or unsuitable equipment
- Engages in disruptive, threatening, or unlawful conduct
- Misrepresents experience, eligibility, or qualifications
A participant removed for unsafe, unlawful, or seriously disruptive conduct will not be entitled to a refund.
13. In Person Training Cancellation and Refund Policy
Unless a course listing states a different policy, the following applies.
13.1 Cancellation by the Student
A cancellation request must be submitted in writing to support@fidelityarms.com.
For cancellations received:
- More than 30 calendar days before the course: Refund of the amount paid, less a 10 percent administrative fee, or full account credit
- 15 through 30 calendar days before the course: 50 percent refund or full account credit
- 14 calendar days or fewer before the course: No refund, but account credit may be offered if we can fill the participant’s seat
- Failure to attend: No refund or credit
The specific course listing may establish a different cancellation policy for visiting instructors, limited enrollment programs, private lessons, facility rentals, travel expenses, or other nonrecoverable costs.
13.2 Transfers
With prior approval, you may transfer your registration to another eligible participant. Transfer requests must be received before the course and may be subject to verification of eligibility and prerequisites.
13.3 Rescheduling
Account credits and rescheduling rights:
- Are not redeemable for cash
- Must be used within 12 months
- Are subject to course availability
- May be limited to one rescheduling request
13.4 Cancellation by Fidelity Arms
Fidelity Arms may cancel or reschedule training because of:
- Unsafe weather
- Range closure
- Instructor illness or unavailability
- Insufficient enrollment
- Safety or security concerns
- Events beyond our reasonable control
When Fidelity Arms cancels a course, you may generally choose:
- Transfer to the rescheduled course
- Account credit
- Refund of the course fee paid
Unless expressly stated otherwise, Fidelity Arms is not responsible for travel, lodging, meals, ammunition, rental vehicles, lost wages, or other incidental expenses.
13.5 Weather
Firearms training may occur outdoors and in varying weather conditions. Training will not necessarily be canceled because of rain, heat, cold, or other ordinary weather.
Students should arrive prepared for the forecasted conditions. Fidelity Arms will determine whether conditions permit safe training.
14. Separate Waiver for In Person Activities
Participation in in person firearms training may require you to sign a separate:
- Acknowledgment of risk
- Release of liability
- Assumption of risk agreement
- Medical authorization
- Photo or video release
- Range specific waiver
The separate waiver is incorporated into these Terms by reference.
If you refuse to sign a required waiver before the applicable deadline, you may not participate. Any refund will be determined under the cancellation policy in effect for that course.
These Terms do not replace a properly prepared activity specific liability waiver.
15. Intellectual Property
The Fidelity Arms website and its content are owned by or licensed to Fidelity Arms and are protected by copyright, trademark, and other intellectual property laws.
Protected materials include:
- Course videos and scripts
- Written lessons and articles
- Workbooks and training plans
- Graphics, photographs, diagrams, and presentations
- Logos, trademarks, slogans, and branding
- Website design and organization
- Audio recordings and podcasts
- Proprietary training methods and course structures
“Fidelity Arms,” “Principles. Practice. Performance.,” and associated branding may not be used without written permission, except as permitted by law.
16. Third Party Services and Links
The website may contain links to third party websites, ranges, instructors, equipment providers, payment processors, video platforms, or other services.
Links are provided for convenience and do not necessarily constitute endorsement.
We do not control and are not responsible for third party content, policies, availability, products, security, or conduct. Your use of a third party service is governed by that provider’s terms.
17. Availability and Website Changes
We do not guarantee uninterrupted or error free access to the website.
Access may be limited because of:
- Maintenance
- Updates
- Technical failures
- Security events
- Internet or hosting outages
- Events beyond our reasonable control
We may modify, suspend, or discontinue features when reasonably necessary. We will make commercially reasonable efforts to avoid unnecessarily depriving customers of paid access.
18. Suspension and Termination
We may suspend or terminate your account or access when we reasonably believe that you have:
- Violated these Terms
- Shared or copied protected content
- Engaged in fraud or payment abuse
- Created a safety or security risk
- Harassed another user, instructor, or staff member
- Used the services for unlawful purposes
- Attempted to interfere with the website or another account
Termination for a material violation may result in loss of access without a refund.
You may stop using the services at any time. Stopping use does not automatically cancel a recurring membership. Memberships must be canceled using the cancellation process described above.
19. Disclaimers
To the fullest extent permitted by law, the website and services are provided “as is” and “as available.”
Fidelity Arms disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not warrant that:
- The services will meet every user’s needs
- The website will always be available
- Content will be free from errors
- Any particular result will be achieved
- Information will remain current indefinitely
Some jurisdictions do not permit the exclusion of certain warranties. In those jurisdictions, these exclusions apply only to the extent legally permitted.
20. Limitation of Liability
To the fullest extent permitted by law, Fidelity Arms and its owners, officers, employees, instructors, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the website or services.
This includes loss of income, profits, data, business opportunities, reputation, travel expenses, or other consequential losses.
Except for liability that cannot legally be limited, our total liability arising from a particular purchase or service will not exceed the amount you paid to Fidelity Arms for that purchase or service during the 12 months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability when such exclusion or limitation is prohibited by applicable law.
In person training may also be governed by a separate assumption of risk and liability waiver.
21. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Fidelity Arms and its owners, officers, employees, instructors, contractors, and affiliates from claims, damages, liabilities, judgments, and reasonable legal expenses arising from:
- Your unlawful or unsafe conduct
- Your violation of these Terms
- Your infringement of another person’s rights
- Content you submit
- Your misuse of the website, instruction, or training materials
This section does not require you to indemnify Fidelity Arms for conduct for which indemnification cannot lawfully be required.
22. Dispute Resolution
Before filing a legal claim, you agree to send a written notice describing the dispute to:

The parties will attempt in good faith to resolve the dispute informally for at least 30 days after the notice is received.
This requirement does not prevent either party from seeking urgent injunctive relief or filing an eligible claim in small claims court.
23. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict of law principles.
Unless applicable law requires otherwise, any legal proceeding arising from these Terms or the services must be brought in a state or federal court with jurisdiction in or serving Jessamine County, Kentucky.
You and Fidelity Arms consent to the personal jurisdiction and venue of those courts.
24. Changes to These Terms
We may update these Terms to reflect changes in our services, business practices, or legal obligations.
The revised Terms will be posted with a new “Last Updated” date.
When a change is material, we may provide additional notice through the website, account, or email. Changes will apply prospectively unless applicable law permits otherwise.
Your continued use of the services after the effective date of revised Terms constitutes acceptance of the revised Terms.
Material changes to recurring payment terms will be disclosed separately when required by law.
25. Electronic Communications and Acceptance
You consent to receive agreements, disclosures, receipts, notices, and other communications electronically.
Selecting an acceptance checkbox or button, creating an account, registering for a service, or completing a purchase constitutes your electronic acceptance of these Terms.
You may retain a copy by printing or saving this page.
Marketing communications are governed by applicable law and any communication preferences made available to you.
26. General Provisions
26.1 Entire Agreement
These Terms, the Privacy Policy, any applicable refund policy, course description, checkout disclosures, and signed training waiver constitute the agreement between you and Fidelity Arms regarding the applicable service.
26.2 Order of Priority
If documents conflict, the following order generally applies:
- A signed in person training waiver for matters involving activity risks and liability
- Specific written terms displayed for the purchased course, event, or membership
- These Terms of Service
- General promotional materials
26.3 Severability
If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective.
26.4 No Waiver
Failure to enforce a provision does not waive the right to enforce it later.
26.5 Assignment
You may not assign your rights or obligations without our written consent.
We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or transfer of the business.
26.6 Force Majeure
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disasters, range closures, government actions, public emergencies, utility outages, labor disruptions, internet failures, or instructor emergencies.
26.7 Headings
Section headings are for convenience and do not change the meaning of these Terms.
